Terms of service

Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed through our online store by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is a natural or legal person or a partnership with legal capacity acting in the exercise of its commercial or independent professional activity.

2. Contract Partner

The purchase contract is concluded with:

PAWTRAIL
Kalk-Mülheimer Str. 118a
51065 Köln
Germany

Email: pawtrail.official@gmail.com

3. Conclusion of Contract

The presentation of products in our online store does not constitute a legally binding offer but an invitation to place an order.

By clicking the button “Complete Order”, “Buy Now”, or a similar button during the checkout process, you submit a binding offer to purchase the products in your shopping cart.

After submitting your order, you will receive an automatic confirmation email acknowledging receipt of your order. This confirmation does not constitute acceptance of your offer.

The contract is concluded when we expressly accept your order or dispatch the goods.

4. Prices and Payment

All prices displayed in the online store are stated in the applicable currency and include statutory VAT where legally required.

Shipping costs are displayed separately during the checkout process.

Payment may be made using the payment methods offered in our online store. We reserve the right to exclude certain payment methods for individual orders.

5. Delivery

Delivery is made to the address provided by the customer during the ordering process.

Delivery times stated on the website are estimates and may vary depending on the destination country, customs processing, carrier performance, and other circumstances beyond our control.

If a product is unavailable after an order has been placed, we reserve the right to withdraw from the contract. In such cases, any payments already made will be refunded without undue delay.

6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal.

Details regarding the right of withdrawal can be found in our separate Cancellation Policy.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Warranty and Liability for Defects

The statutory warranty rights apply.

If delivered goods are defective, customers are entitled to the legal remedies available under applicable consumer protection laws.

Customers are encouraged to inspect delivered goods promptly and notify us of any obvious defects.

9. Limitation of Liability

We are liable without limitation for damages resulting from intentional misconduct or gross negligence.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations, and liability shall be limited to foreseeable damages typical for the contract.

The above limitations shall not apply to claims arising from injury to life, body, or health, nor to claims under mandatory product liability laws or where liability cannot be excluded by law.

10. Product Information

We strive to ensure that product descriptions, images, and specifications are accurate.

However, minor variations in color, appearance, dimensions, or packaging may occur due to manufacturing processes, screen settings, or other technical factors and shall not constitute defects.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at:

https://ec.europa.eu/consumers/odr/

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by applicable law.

12. Applicable Law

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing in another EU Member State, you also benefit from the mandatory consumer protection provisions of your country of residence.

13. Severability Clause

Should any provision of these Terms and Conditions be held invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
